2. Purpose

These General Terms and Conditions of Sale govern all sales carried out through the website lepetitlapinbleu.com. Any order implies full acceptance of these terms and conditions.

3. Products

The products offered consist of original artworks created either by independent partner artists or directly by Le Petit Lapin Bleu.

Each artist guarantees that they hold all necessary rights to market the artworks offered for sale.

4. Role of Le Petit Lapin Bleu

Le Petit Lapin Bleu operates an online platform enabling the presentation and commercialization of artworks offered by independent partner artists.

For artworks offered by partner artists, Le Petit Lapin Bleu acts as a commercial intermediary responsible for promoting artworks, connecting buyers and artists, and managing the technical operation of the platform.

  • the sales contract is concluded directly between the buyer and the selling artist;
  • the artist remains the legal seller of the artwork;
  • the artist is responsible for creation, description, conformity and shipment;
  • payments are securely processed by an authorized payment service provider;
  • the gallery provides customer support and logistical coordination.

Le Petit Lapin Bleu automatically receives a commission for its intermediation services.

When artworks are offered directly by Le Petit Lapin Bleu, the gallery acts as the seller.

5. Solidarity Commitment

Le Petit Lapin Bleu operates as a solidarity art gallery supporting partner charitable organizations.

A significant portion of the net profits effectively generated from commissions received may be donated to partner charities.

Net profit is determined after deduction of, among others:

  • payment processing and banking fees;
  • logistics and transport costs;
  • marketing and communication expenses;
  • legal and accounting fees;
  • technical and administrative costs.

These expenses may represent up to approximately 10% of the sale price.

The gallery may allocate approximately 80% of net profits to supporting partner charities.

Such contributions are voluntary commitments and do not constitute a contractual component of the purchase price.

Contributions may take the form of financial donations, sponsorship actions, solidarity partnerships, or any other mechanism compliant with applicable regulations.

This commitment applies exclusively to artwork sales completed through the gallery.

6. Prices

Prices are indicated in euros (€). Shipping or insurance costs may apply.

Availability

As artworks are unique, availability cannot be guaranteed. In case of unavailability, any payment made will be fully refunded.

7. Order and Payment

An order is confirmed once secure payment validation has been completed.

Payments made on the website are processed by an authorized payment service provider ensuring transaction security.

For artworks offered by partner artists, payment is made for the benefit of the selling artist through the payment service provider. Le Petit Lapin Bleu receives, through the same provider, a commission for its intermediation services in accordance with the applicable contractual terms.

8. Delivery

Shipping

Shipping is carried out by the artist responsible for packaging the artwork.

Transport Organization

The gallery may organize transportation through independent service providers.

Insurance

Le Petit Lapin Bleu acts neither as carrier nor insurer.

Transfer of Risk

The transfer of risk occurs in accordance with applicable legal provisions.

9. Damage or Loss

Any anomaly must be reported within 48 hours after delivery.

10. Refunds

A refund related to a transport claim may be suspended until the case has been fully resolved.

11. Right of Withdrawal & Returns

The customer has a legal withdrawal period of 14 days following receipt, except where legal exceptions apply.

Unless otherwise agreed or in case of proven defect, return shipping costs remain the responsibility of the customer. The customer is responsible for organizing the return shipment, associated costs, and secure packaging.

The artwork must be returned using packaging providing protection equivalent to that used during initial delivery. Any damage resulting from insufficient packaging may engage the customer’s liability.

12. Liability

  • Le Petit Lapin Bleu is not the manufacturer;
  • not the author;
  • not the carrier.

Conformity and authenticity remain the responsibility of the selling artist unless the gallery acts as direct seller.

13. Abuse Prevention

The gallery may request any supporting documentation necessary before processing a claim.

14. Intellectual Property

All artworks remain the intellectual property of their respective authors.

15. Personal Data

Personal data is processed in accordance with GDPR regulations.

16. Applicable Law

These Terms and Conditions are governed by German law.

17. Modification of Terms

Le Petit Lapin Bleu reserves the right to modify these Terms and Conditions at any time.
